The present thesis deals with aspects of the legal relationship between the State and those ancient and modern monuments constituting its cultural heritage, in the light of Article 24 paragraphs 1 and 6 of the Greek Constitution and Law 3028/2002 “on the protection of antiquities and, more generally, cultural heritage”. The Greek Constitution establishes the protection of cultural heritage as both an obligation of the State and a right of everyone. In the same vein, the Council of State has held the protection of cultural heritage to be a constitutionally protected value. The concept of “cultural heritage” comprises those ancient and modern monuments which carry an aesthetic and architectural value and occupy a significant position in the preferences of those visiting Greece. At the same time, those monuments amount to a timeless testament to human life and a necessary condition of the shaping and preservation of collective, historical memory.

The thesis speaks to the legal nature of monuments as res extra commercium/choses hors du commerce, as well as to the manners in which they become part of the public domain. Furthermore, the thesis identifies -by relying on case-law of the Council of State- conflicts between the protection of the cultural environment and other constitutionally protected values, whilst it seeks to circumscribe the criteria one may resort in order to balance these values and interpret and apply them in a harmonized manner.

According to the conclusions of the present thesis, the protection of monuments, perceived as elements of the cultural environment, amounts to an autonomous consideration of public interest. Yet, it serves a parallel function, namely the protection of cultural monuments contributes to the preservation of historical memory as a building block of Greek collective identity.
