Summary:
Unilaterally imposed work is a manifestation of the employer’ s right, in the light of his business needs, to suspend the employment relationship for a certain period of time without any guarantee of workers' rights. This is due to the concise and unclear regulation, which raises a lot of difficulties and thus creates a background of misuse of the measure.
The basic ambiguity is found in the essential condition of the institution, in the limitation of activities, in the nature of the measure as individual or collective, but also in the way of rotation of the periods of employment and non-employment of the rotation workers. Practical implementation of the measure often involves the introduction of rotation systems with one or two days of weekly work. The absence of a regulation concerning the minimum working time of rotation employees and compensatory measures to cover lost earnings often leads to the fact that rotation workers are paid less than the unemployment allowance. While it is classified as a 'measure instead of a termination of employment contract’, it often has the opposite result. The only way to control and safeguard workers' rights is the judicial review of potential illegality and misuse.
