Summary:
This paper examines the ban on face concealment in public in the framework of the European Convention on Human Rights (ECHR). Through the SAS v. France decision, it is examined whether the justification of the ban on face concealment by the ECtHR keeps up with the protection of human rights. An argument regarding the exemption from general laws by invoking one's religious beliefs is examined. However, this line of argumentation is found unsatisfying and is rejected. On the other hand, ECtHR's stance towards ban on face concealment proves to be problematic under the ligh of the principle of equal treatment. The duty of equal treatment includes the state's duty to provide all citizens with an equal opportunity in shaping the social and cultural environment in which they spend their lives.
