Summary:
This paper examines EU's accession to the ECHR as a chance to explore the CJEU's stance towards human rights. After presenting the historical background, Opinion 2/13 concerning accession is examined. Through the example of data protection, the different perspective between ECtHR and CJEU towards human rights issues is highlighted, while a navigation through CJEU's argumentation regarding the rejection of the Draft Agreement is attempted. CJEU's negative stance towards accession could be explained by EU's special nature and historical development. However, CJEU shall take into account the latest developments, as seen in the Lisbon Treaty, according to which human rights protection is one of the EU's primary goals.
