Summary:
The subject of the present diplomatic dissertation is Directive (EU) 2015/2436 of the European Parliament and of the Council of 16th December 2015 to approximate the laws of the Member States relating to trade marks. More specifically, an attempt is made to interpret the provisions of the new Directive, the significant amendments and the new provisions introduced thereby in connection with the current Law 4072/2012, until the new directive is incorporated into our national law. The aim of Directive 2015/2436 and of Regulation 2015/2424 is to achieve the modernization of the national laws and their orientation towards the European Union trade mark system.

In the first part of the present paper, the concept of the trademark, the basic principles governing the law of trademarks, and mainly the innovations introduced by the Directive 2015/2436 are presented. Furthermore, the procedural and basic requirements for the filing and registration of trademarks are analyzed, the absolute and relative grounds for registration, as defined in Directive 2015/2436, as well as the legal remedies available to interested parties.

The subject matter in the third part of the dissertation is the rights conferred by a trade mark, as well as the possibilities for economical exploitation of the proprietor’s right to the registered trademark, whereas in the final part of said paper are presented the loss reasons of the right to a trademark, and the legal protection in case of infringement of the right by a third party.
