Summary:
If we adopt the assumption that law and basic rights in particular should be linked to morality, then Thomas Scanlon’s theory seems be one of a particular interest. The goal of the dissertation is to examine whether it is possible to draw conclusions from Thomas Scanlon’s theory, that will be useful to the domestic legal science. The first chapter focuses on the relationship of law and morality and develops by comparing the theories of legal formalism and legal realism, as they take place especially in the context of the United States of America. The reasons why basic rights should be understood as moral imperatives are highlighted. In the second chapter reference is made to Thomas Scanlon's theory, mainly to his contratualism, but also to individual positions of interest to the research subject matter of the dissertation. The third chapter highlights Scanlon's positions on the general part of basic rights and they are contrasted with critical mood towards the domestic theory’s positions. The fourth chapter summarizes the conclusions of the dissertation and supports the thesis that Scanlon's theory can provide useful data for understanding the general part of basic rights.
