Summary:
The tensions in Middle East and Africa over the last decade have led to the displacement of thousands of people in search of a safe haven in Europe. Faced with a massive refugee flow and a consequent migratory flow, in the absence of legal routes, the EU searched for legal and political tools to manage the situation in order to ensure the protection of refugees and at the same time to protect its borders. On 18th March 2016, following the closure of the balkan route and the confinement of thousands of refugees and migrants in Greece, the EU - Turkey “Agreement” was adopted to reduce the flows to the EU and to tackle human trafficking and smuggling networks. However, the provisions for the return to Turkey of all illegally arriving refugees and migrants raise concerns about the "Agreement"’s compatibility with international and European refugee law, notably with the principle of non-refoulement and the concept of the "safe country". Also, the measures taken to ensure its implementation, such as detention, raise doubts about the sincere protection of human rights
