Summary:
Τhis dissertation deals with the issues relating to the legal characterisation within the field of international succession law of the EU and, more specifically, within the field of the Regulation 650/2012. Its goal is to demonstrate how, even with such a carefully edited text, issues relating to the scope of the Regulation may arise as well as issues relating to the interpretation of the terms used in the Regulation and to to evaluate the solutions undertaken. This dissertation is divided into two sections. The first analyses the reasons that pushed the EU into the adoption of the aforementioned text, as well as the goals of the Regulation. Further, the main terms and elements of the Regulation are mentioned and, finally, the scope of the Regulation is examined. The second and main part of the dissertation begins witht the analysis of the legal characterisation within the fields of european and private international law and locates the issues that have arised. Chapter B deals with the issue of legal characterisation that arose in the field of property law and how it was resolved by the ECJ. Similarly, Chapter C deals with issues realting to the legal characterisation in the field of corporate law and the way in which they were resolved by greek case-law and, more specifically, by the judgment 1421/2014 of the Greek Supreme Court (Areios Pagos). The second part of the dissertation finishes with the issues that arose from the legal characterisation in the field of matrimonial property regimes through the judgment C-558/16 of the ECJ. Finally, the dissertation reaches its end with the concluding remarks of the author in relation to the analysis of the topic at hand.
