Criminal Liability of Legal Persons
Summary:
In this paper we attempt to analyze the issue of the criminal liability of legal persons from the beginning of the relevant discussion until today's prevalence in the majority of the Anglo-Saxon states initially and subsequently the states of the Continental Law, the arguments that put forward and the relevant theoretical controversy. Afterwards we will mention to the form that this liability took in the various countries that have so far been institutionalized, since a common model has not been adopted even in countries within the European Union, while a separate reference will be made to the obligation to institutionalize liability for legal persons (criminal, administrative or civil) contained in the international texts that our country has signed as well as the relevant pressures imposed on it to the countries that are still "resisting" to this. Finally follows a de lege ferenda proposal on the form of the relevant liability that the Greek legislator could adopt in order to establish liability of legal persons in the Greek legal order.
