Inconsistent excercise of rights in english and greek law
Summary:
The present dissertation belongs to the field of comparative legal studies. Specifically, the analysis and comparative examination refer to the regulations of english and greek civil law dealing with the problem of inconsistent excersice of rights. In this context, english law involves the multifaceted principle (or doctrine) of estoppel, which seeks to prohibit inconsistency in daily transactions, while greek law contains the general clause of Article 281 Civil Code, which establishes objective criteria for assessing the exercise of rights. The comparison of estoppel, under its specific and applicable in this case form, ie promissory estoppel with the application of Article 281 Civil Code shows that, even though they belong to different legal families, the laws concerning us share some common features with notable being equity as a corrective legal mechanism originated by Aristotle.
