Summary:
The purpose of this paper is to present the public interest in the context of the special law on the reorganization of financial institutions and investment firms. The public interest should initially be examined through the presentation of the banking resolution regime, as its cornerstone and then, in the specific light of the public interest criterion, as the ultimate condition for the activation of the resolution process. It is through this reasoning, but also through the relevant decisions, that the broad scope of the public interest is limited as a legal term and determined as precisely as possible within the resolution process. However, the interest of this work extends to the broader nature of the eurozone's financial stability, as a cause for greater European integration, as well as to the growing interplay between the economy and the law. The public interest in the resolution regime reflects the endless conflict between public authority and fundamental rights, enriched with the influx of economic figures into the law and the strengthened harmonization within the European Union.
