Summary:
The present dissertation constitutes an attempt to depict the fundamental pillars of the matters, concerning international child abduction, aka the wrongful removal or retention of a minor to a different state, other than the state of their habitual residence. International child abduction, as a civil dispute of international family law, constitutes a direct breach of the recognized and granted rights of custody and access, violating the rights of both the left - behind parent and the abducted child. On one hand, the dissertation mainly focuses on the International Hague Convention of the 25th of October 1980, on the civil aspects of international child abduction, while, on the other hand, the contractual arrangements of the Convention are enhanced and completed by the arrangements of the no. (EC) 2201/2003 Regulation (Brussels IIbis), including appropriate arrangements, concerning the cases of intra - european abductions, within the field of parental responsibility. Firstly, the fundamental legislation applied on matters related to the international protection of children and children's personal status, is examined, in an overview of the general legal framework of child protection in the European Union. Consequently, the pillars of interaction between the most important legal texts, applied in cases of international child abduction, are presented, on the basis of important aspects, such as parental responsibility, custody and access rights, the return of the abducted child and the right of all the parties to be heard and to express their views on the matter. Finally, a comparative overview of the crucial legislation is attempted, in the scope of underlining its contribution to the resolution of the international child abduction phenomenon, within the limits of the European Union and of accurately defining the notion of the child’s best interest. These levels of evaluation work in the direction of highlighting the importance of the upcoming revision of the Brussels IIbis Regulation (Brussels IIter) and the drawing of the final conclusions. Additionally, all the above are validated and proven by a plethora of national (greek) and international case-law examples, while the European Courts’ case-law (CJEU and ECtHR), is also considered invaluable.
