The principle of transparency in the banking terms of mortgage lending
Summary:
The aim of the present study is to analyse the basic principle of transparency in individual banking terms of mortgage loans and to highlight its importance for the consumer. By means of the two Directives 93/13 / EEC on unfair terms and of Directive 2014/17 / EU on mortgage credit, an overview will be made of this subject in order to ascertain the relationship between the two Directives and how this is reflected in practical level in the context of a home loan agreement. The use of case law by the Greek courts as well as by the Court of Justice of the European Union (CJEU) will highlight the compliance with the requirements of the principle of transparency in the general conditions of transactions in mortgage contracts, but also will investigate the practical application of the principle of transparency in the banking market of modern Greece in 2018, which as a victim of the economic crisis, is trying to recover and create a climate of trust and protection for the consumer.
