Summary:
Modern banking law is a sector of law that is continually evolving on an international level and is trying to respond το increasing socio-economic needs, characterized by mass, speed, complexity. However, the growing bank mediation in the money market and over-funding can create problems. In recent years, the international financial crisis has shaken the relationship between bank and customer and the increased bank lending has led to over-indebtedness and inability to repay and comply with the agreement, resulting in the need for legislative intervention to deal with the situation. The subject of this diploma thesis is the analysis of how banks determine the interest rates and the function of them, the risks and interests that accompany the fixed and floating rate, especially for the early repayment of loans, checking the general terms and conditions of credit agreements, unfair terms cases and legal consequences according to the consumer protection law and recent case-law, and particularly the aspects of unilateral modification of credit terms.
