Environmental protection in European Union' s secondary legislation with regard to public procurement and public concession
Summary:
This thesis is divided in two extensive sections. The first one focuses on the gradual integration process of environmental protection in public procurement legislation. Beginning from significant cases of the Court of Justice of EU that accepted external targets during the process of procurement award, we observe the adopting of environmental causes in the secondary legislation of EU in an attempt to make some conclusions as for the dynamics behind this development, to perceive the current situation and to consider about possible reforms. The second section is writend based on the provisions of the last Directives (those of 2014) and it analyses the scope of sustainability in this legislation from the beginning of the procurement procedure till the performance of the contract. Moreover, in the same section, we try to formulate some general principles or, even, requirements with regard to the implementation of the «green» provision of the Directives from the point of competition law.
