The protection of health data
Summary:
The rapid development of technology, networking and information systems has resulted in many changes which also influences health data. The use of new technologies has rapidly increased the possibilities of processing personal health data and new measures must be taken in order to establish a strong data protection framework. In this context, the Regulation (EU) 2016/679 confirms the principles relating to processing of personal data and the rights of data subjects, adding new ones, and specifies the obligations of the controllers and processors. In addition, the Regulation adhere to a risk based approach as it maintains provisions concerning the processing of special categories of personal data in comparison with other data. For this reason, this Regulation includes the definition of "data concerning health" as well as the definition of genetic and biometric data. This study attempts to highlight the regulations of health data protection according to the General Data Protection Regulation (Regulation 2016/679).
