Summary:
The present thesis revolves around certain theoretical issues in international arbitration, which exist at the intersection between private international law and the more restricted field of international arbitration. The main subject concerns the application by arbitral tribunals of overriding mandatory provisions of law and the effects of this application on the fundamental notion of party autonomy in international commercial arbitration. Beginning with the definition of overriding mandatory provisions, the thesis contemplates the nature and function of these rules in the context of the methodology of private international law renders and subsequently their application by international arbitral tribunals and state courts in relation to arbitration, both on the level of European Union law and at an international level.
