Summary:
In this thesis, minority holdings are analyzed in the light of the ΕU Merger Regulation. The purpose of this dissertation is to report and analyze minority holdings and their related concepts. In the beginning, the author presents the necessary concepts in order to provide deeper understandings on the real issues related to the subject, mainly by focusing on the analysis of the concept of control in concentrations, which is recognized as the first step to explore in depth the meaning of minority participation.

Subsequently, the author analyzes with simple examples and understandable definitions what is minority interest, what is the broadest category to which it belongs and which are
its species. Having embedded these essential meanings, the anti-competitive effects of minority holdings are investigated in the light of the specific merger law as well as economic theory. Legal instruments and limits of the Commission 's jurisdiction have been examined with regard to non-controlling minority shareholdings while theory and jurisdiction have been embedded in the examined concepts.

Finally, the author concludes that a “regulatory gap" exists in the Regulation 139/2004 and therefore states possible proposals to address it.
