Summary:
The subject of this thesis focuses on how works contract, and specifically contracting -out, can be an alternative choice for a company instead of having employees to do this task. This practice is examinated in the light of the balance between flexibility and security, which leads to dilution of rensposibilities. For this purpose, in the second chapter the essential characteristics of these contracts are presented while at the same time the criteria of juristinction for each of these forms are evaluated.
Subsequently, the third chapter consists of an overview of regulations applied in Greece, which aim at the protection of employees. Particularly, they provide for liability for employers' obligations(employment conditions,wages etc) is extended between contractor and the master of work, although there isn't contractual relationship between employees of contractor and the master of work.
Furthermore, the fourth chapter deals with the question if this practice of company can hide temporary work and for this purpose the proposed criteria are evaluated. However, we assess the difficulties regarding the application of rules for temporary workers.
Finally, conclusions are drawn and recommendations are made as to the ways and means to ensure and improve the level of protection of employees, who are used by a contractor in order to carry out a task that the master of work has assigned to him.
