The criminal law response to stalking
Summary:
Τhe present paper examines the phenomenon of stalking as a criminal offense. Following a description of the characteristics of the stalking behaviour, the main focus is put on the initiative of legally codifying against stalking in terms of criminal law. The paper continues with a critical overview on the criminal legislation against stalking at international and european level, with particular regard to the case-law developed by the European Court of Human Rights (ECHR). The last part of the paper analyses the greek provision on stalking. Τhis analysis is accompanied by the simultaneous assessment of the choices made by the Greek criminal legislator.
