The concepts of indirect damage and indirect victim in tort law

This paper deals with the concepts of indirect damage and indirect victim in the system of tort liability. An effort is made to approach the limitation on recovery of damage. That concept covers in particular whether damage shall cover any consequence arising out of a tort and apart from that, whether a person other than the direct victim may obtain compensation “by ricochet” following damage sustained by the victim. This reflection is a thorny issue of tort law, for the approximation of which a combined interpretation of the causal link and the protective purpose of the rule of law is needed. Finally, it is taken into consideration the impact of this problem in the field of SA, where the Board of Directors may cause “indirect” damage to the shareholder.
