European legislative framework in the context of the protection of children applicants for international protection
Summary:
The refugee and immigration crisis of 2015 has led to developments and trends of reforms in the CEAS. A special group of people moving to the EU, because of their vulnerability, are children accompanied or unaccompanied. The movement of these children is taking on ever increasing dimensions at European level, entailing significant real and legal consequences for both the country of origin, the country of transit and the host country, and their personal situation, and leads to the need for a systematic characterization of Alien law to a new, specialized and autonomous field of law. The aim of this paper is to set out the European legislative framework in the context of the protection of children applicants for international protection and the functioning of this regime in practice through the administrative practice but mainly by the case law of the CJEU and the ECtHR and the efforts to improve it.
