Summary:
In an attempt to highlight bioethical concerns regarding surrogacy, the three dominant legal approaches of surrogate motherhood (french, american, greek) are examined, as well as the ethical questions raised by each of them. These legal approaches are examined in terms of their moral justification, and not merely from a purely legal point of view or for comparative study purposes. The present thesis focuses on the surrogate mother and what is her body's disposal in this process. Both the right to self-determination and the freedom of contract are examined, as well as a Kantian critique to self-ownership.
