Summary:
The European Union has set itself the objective of maintaining and developing an area of freedom, security and justice in which the free movement of persons is ensured. For the gradual establishment of such an area, the Union is to adopt measures relating to judicial cooperation in civil matters having cross-border implications, particularly when necessary for the proper functioning of the internal market. Ιn order for a succession with cross-border implications within the Union to be settled speedily, smoothly and efficiently and be able to demonstrate easily their status and/or rights and powers in another Member State, the Regulation (EU) 650/2012 creates the European Certificate of Succession to be issued for use in another Member State. In order to respect the principle of subsidiarity, the Certificate should not take the place of internal documents which may exist for similar purposes in the Member States.
