Summary:
My master thesis examines the legal status of the Greek Mufti and in particular the
sources of the law, which include the historical evolution of the relevant regulations.
The Mufti’s juridical authority is also examined in both the forum externum and the
forum internum. In addition, the ECHR's case law is presented and analyzed, focusing
on the consideration of certain judgments such as Agga v. Greece, Serif v. Greece,
Hasan and Chaoush v. Bulgaria, and the very recently published Molla Sali v. Greece.
Also a case-law and legislative approach to Mufti's presence is presented, according
to the elements and the essence of the Greek legal system. In conclusion, this master
thesis examines the legal arguments on Mufti's jurisdiction and analyzes the internal
juridical system of Muslim communities and its relationship with the state. The
structure of my research was bibliographical, legislative and jurisprudential. In
addition, an attempt was made to critically approach the issues this thesis deals with.
