Summary:
This master thesis is based on the psychiatrist’s civil liability, as a medical practitioner, towards the patient suffering from mental illness but also towards the latter’s family environment and in general towards society as a whole. In particular, the legal framework for the exercise of its function is examined, as well as the medical treatment contract between the psychiatrist and the patient, its specific requirements and the main obligations arising from it, especially the obligation to provide information, to obtain patient’s consent and to keep medical records and confidentiality. Furthermore, the existence of the psychiatrist's right to refuse to provide medical care and the concept, distinctions and specific issues related to psychiatrist’s medical error and his civil liability. In addition, there is a section about the way and the ability of a psychiatrist to appear in a court of law, while some ethical issues of psychiatric function are highlighted. In the second part, the analysis concerns the psychiatric nurse, his role, the legal status under which he carries out his nursing service and the legal basis of his civil liability. Finally, the ethics of the profession of psychiatric nurse is being studied.
