The "Appropriation Art" method and the protection of integrity of the artwork
Summary:
"Appropriation art" is a new method of art collecting pictures and styles of the past, with which artistic combinations can be formed, free of any sense of hierarchy and time priority. This art practice of "using" images of the past as a creative proposition by modern artists has created many debates about its intentions and authenticity. Because of its radical nature, appropriation art goes beyond the concept of the creator or the originality, and intellectual property law needs to assess this phenomenon and integrate it into its protective gulf. Therefore, it remains an unsolved issue of intellectual property, whether this method of art should be recognized and protected, since the acceptance of the appropriation art movement could lead to the paradoxical conclusion that no work belongs to any creator overturning the entire history of art and intellectual property. This study attempts to analyze the concept of the appropriation art movement through a historical and legal approach to this new phenomenon.
