Summary:
The subject of this paper is the institutional framework for the protection of employees' personal data introduced by Regulation 2016/679. Labor law and data protection law are complex and interact. The collection and processing of personal data is an intrinsic element of the labor relationship. A comparative overview of the provisions of the Regulation with the provisions of the repealed Directive 95/46, which aims to show if the Regulation achieves greater protection, is therefore being undertaken. Finally, the innovations of the Regulation with regard to the labor relationship and the sanctions imposed on the employer in the event of violation of the provisions of the Regulation are analyzed.
