Investigative journalism in the modern case-law of the European Court of Human Rights
Summary:
The purpose of the current thesis is to identify the limits of journalistic research, as they are formed within the case-law of the European Court of Human Rights, as well as to demonstrate the criteria which the Courts takes into consideration while assessing the necessity of a specific interference of a member state with the exercise of press freedom. The first chapter of the thesis provides an overview of the right to freedom of expression, as enshrined in article 10 of the European Convention of Human Rights. Special emphasis is given to press freedom and matters that refer to journalistic research. The second chapter demonstrates the most important judgments of the ECtHR since the beginning of the 21st century concerning the topic of investigative journalism and emphasizes on the criteria that the Court takes into consideration at each case. Finally, the third chapter contains a brief analysis of these certain criteria considered by the Court when balancing conflicting rights.
