Summary:
The purpose of this paper is to take part in a debate on paternalism that began in the past and today remains diachronic, complex and interesting on a theoretical, philosophical and legal level. It poses the question if paternalism is a pro tanto error, if it is incompatible with liberal democracy, and after a brief tour of useful concepts begins with anti-paternalism, explores shocks in the building of anti-paternalism(mostly against the absolute form) and studies the notions of hard, soft, and Kantian paternalism. The following is a reference to theories that do not consider paternalism as an evil to exist from the outset (a reference to Conly and to theories). After referring to the endorsement thesis, the paper will attempt to apply the above to the special (?) example of drug use for non-therapeutic purposes.
