Summary:
The rapid evolution of the artificial intelligence technology and the development of advanced machine learning techniques expand the legal horizon raising many questions about the legal treatment of the variety of situations AI is engaged in modern life. Intellectual property and copyright law Is one of the first fields, where artificial intelligence tested its progress and its creative powers. Given examples of AI creations such as The Next Rembrandt, it is an undeniable fact that so-called creative AI exists and is capable of creating works and pieces of art, comparable to the human-produced ones.
This paper deals with the challenges artificial intelligence sets for the classic copyright doctrine, explores the possibilities of integrating creative AI into the current copyright regimes, analyzes the possible regulatory options and proposes for a hybrid model which combines the current copyright scheme and the acknowledgment of the AI-creations as de facto works which are worth of copyright protection.
