Translated title:
Peaceful settlement of the Aegean Sea dispute over the continental shelf
Summary:
The paper focuses on the Greek - Turkish dispute in the Aegean over the continental shelf, from its beginning till this day. Affirming that the dispute is basically of legal nature, the paper refers to the facts and the claims of both sides (Greek - Turkish) and the legal parameters are analyzed. Furthermore, the evolution of the Law of the Sea is examined, on a conventional level, along with relevant cases of maritime delimitation adjudicated by the International Court of Justice which resulted in the crystallization of the three - stage method. The aforementioned method is considered the most probable to be applied in a potential future adjudication of the case by the Court. Lastly, one of the main factors that is regarded to be crucial for the perpetuation of the dispute and the intense politicisation of the subject, despite its apparent legal character, is the public opinion (the paper focuses on the greek public opinion), which, while being negatively predisposed against Turkey, influences and confines on many occasions the handling of the situation by the Greek foreign policy, driving it to be inconsistent and ineffective in resolving the dispute. The public opinion on the subject shapes an environment in which the assumption of the political cost could be proved to be quite disadvantageous for any greek government, something that in its turn makes even more difficult the peaceful settlement of an already complicated legal matter.
