Summary:
The objective of the present thesis is to discuss the notion of public policy in the context of the recognition and enforcement of foreign judgments. More specifically, this thesis examines the use of the public policy exception by the national courts of the contracting parties and the possibility to rely on the right to a fair hearing and the right to the protection of property, as guaranteed by the European Convention of Human Rights, in order to refuse the enforcement of a foreign judgment. This is an issue that becomes even more important in the context of the Brussels 1a Regulation and the European Union legal order due to the objective of free movement of judgments and, consequently, the applicability of the principle of mutual recognition of judgments. In that regard, several conclusions can be drawn. Indeed, it can be concluded that the notion of public policy, as interpreted by national and EU case law, is compatible with the fundamental values of each Member State which are formed, among others, by the rights contained in the European Convention of Human Rights and the Charter of Fundamental Rights of the EU. In addition, the Brussels 1a Regulation establishes a fair balance between the principle of mutual trust and the public policy exception based on the infringement of human rights. The refusal of enforcement of a foreign judgment on public policy reasons should be seen as an exception to the rule, the limits of which are defined and controlled by the Court of Justice of the EU. Finally, this thesis raises the question of whether the refusal of enforcement of a foreign judgment on the basis of public policy could constitute an important tool for dealing with infringements of human rights.
