The international protection of intellectual property between uniform law and private international law
Summary:
This paper prepares an attempt to present the protection of intellectual property rights under both uniform international law and praivate international law. The first part of the paper will analyze the main International Conventions on intellectual property and the basic principles on which they are based, as well as the "acquis communautaire" and EU secondary intellectual property law, ie the fundamental directives of the European Union. The second part, will approach the issue of infringements of intellectual property rights from the point of view of private international law and further analysis of all relevant provisions of the Regulations Rome I, II and Brussels Ia. At the same time, reference will be made to Greek private international law, ie Article 67 of Law 2121/1993 and its comparison with the Rome II Regulation, which of course from its entry into force leaves no room for application of Greek law. Finally, the third part will make specific reference to online copyright infringements, the main legal shields protecting these rights, conflicting approaches to applicable law and jurisdiction, and the interpretation of these conflicts by the Court of Justice of the European Union. Also, throughout the paper, although the validity and predominance of the principle of territoriality is recognized, at the same time, other alternatives are considered in terms of seeking applicable law and international jurisdiction and possible solutions are proposed.
