The implementation of the right of restriction of the sea carrier
Summary:
The present dissertation deals with the issue of the implementation of the right of individual limitation of the sea carrier's liability, as it is legally reflected in the contract of carriage of goods by sea and the charter contract. Its primary purpose is to demonstrate the emerging, critical legal issues of the institution of quantitative limitation of compensation. To this end, the main pillars of the study are: a) the examination of the monetary unit of the restriction, ie the Special Drawing Rights, b) the examination of the calculation bases of the restriction, ie the package (parcel), the unit and the kilo of gross weight, c) the examination of cases of deviation from the legal quantitative limits of liability, ie the shipper’s declaration and the agreement of the parties and d) the presentation of the method of limiting liability in the special case of transport of goods by containers, with emphasis on the analysis of issues surrounding the "container clause". In each thematic unit, an attempt is made to approach the emerging legal issues and to resolve them at national and international level, with simultaneous presentation and critique of the views of theory and jurisprudence around the issue at hand. Finally, in the concluding judgments of the present case, a legal assessment of the institution of limitation of liability is made, while at the same time the problems and difficulties that arise are pointed out and a solution is proposed.
