Summary:
Life in prison, in addition to depriving oneself of personal liberty, often leads to the deterioration of the quality of prisoners' health. The health needs of an inmate are significantly higher compared to free citizens. The consequence of this is the growing demand for medical care services within penitentiaries.
In the present study, the regulatory and empirical aspects of the health right of prisoners are analyzed. In terms of theory, the paper presents the international legal framework, in the light of the adopted provisions from United Nations and the Council of Europe, as well as the national framework, as defined in the Penitentiary Code, in conjunction with the Principles of Medical Ethics.
In the empirical part, the work focuses on a literature review, presenting the findings of international and national surveys as well as findings in detention facilities. Special mention is made of the impact of the coronavirus pandemic on penitentiaries, as well as the policies pursued by the European States and our country to address it, in the face of a risk of "mass deaths" of prisoners.
The present work seeks to investigate the health services and medical care of prisoners, to record the relevant pathogens that result in the violation of the right to health and to present structural and organizational proposals which can lead to an improvement of the conditions with penitentiaries.
