Summary:
Management of migratory and refugee flows has been an issue that has deeply troubled states. Over the passage of time, models of outsourcing and offshoring such management have gained more ground with more and more states engaging in such practices. However, the biggest question remains: how could a State externalize its migration management, while at the same time be in conformity with its obligations under refugee law and human rights law? The present thesis examines models of outsourcing and offshoring such procedures and the restraints posed upon them according to public international law, with a special mention to its scope of application and the extent of state obligations beyond state borders.Starting from the examination of state practice, the thesis at hand aims at giving prominence to possible models applicable in the European context.
