Summary:
The following study is called to address the rights reserved for the maritime transport passenger in the EU legal order. A comparative study of Regulation 392/2009 on carrier liability and passenger rights, Regulation 1177/2010 on passenger rights and Directive 2302/2015 on package travel demonstrates the current legal framework provided to the passenger. an effective protection, combating any arbitrariness and possible abuse of the carrier's dominant position, while strengthening its bargaining power, which until recently was non-existent.
At the same time, a comparative overview of the current EU legislation is attempted, where necessary, in relation to the other means of transport in order to emphasize the multiple similarities between these provisions. The case law of the European courts, which is an important source of law, will be our valuable helper in this endeavor.
This paper deals with the legal perspective of passenger rights under EU law and is structured according to the nature of each right. In addition to the rights to compensation for death or personal injury or loss / damage of luggage, issues that have been on the international scene since 1974 with the Athens Convention, we will be particularly concerned about the rights of refund, compensation in case of delay, withdrawal. protection against insolvency, protection of people with mobility problems as well as a number of rights that are inextricably linked to organized travel, widely known in maritime transport in the form of cruising.
This study was the culmination of a highly demanding but at the same time extremely interesting postgraduate program, which took place under unprecedented conditions. I would like to thank my family, who stand by me unwaveringly, proving daily their faith in my potential.
