Victims’ Rights in Criminal Procedure, the Impact of European Law in Greek Criminal Trials
Summary:
The scope of this thesis concerns the procedural rights of the victims in criminal proceedings. The analysis begins from the historical evolution of the relevant rights in the United States and the United Kingdom as well as in France and German States before and after World War II that constituted a turning point for victim’s rights.
Subsequently, the legislative initiatives at the EU level are presented. Framework Decision 2001/2020 on the status of victims in criminal proceedings and relevant CJEU’s decisions are presented in detail. Moreover, reference is made to the Directive 2004/80 relating to compensation to crime victims and to the Hellenic Compensation Authority.
The impact of the Lisbon Treaty on criminal procedural law and the rights of victims, as well as the impact of the Charter of Fundamental Rights are analysed. Moreover, Directive 2012/29 is thoroughly examined. The analysis includes among others the right to understand and to be understood, the victim’s right when making a complaint, the right to receive information, the right to translation and interpretation, the right to be heard, rights in the event of a decision not to prosecute, the right to legal aid as well as rights in the context of restorative justice services and the right to protection. The relevant case-law of the CJEU is presented alongside Directive 2011/36, Directive 2011/93, and Directive 2017/541.
Securing the rights of the victims through ECtHR’s case law also constitutes an important aspect of this thesis. In this context, positive obligations are analysed (articles 2,3,4, and 14 ECHR) and examined in detail through case-law. Moreover, the scope of article 6 ECHR relating to victims is specified and the specific rights arising from case-law are presented. The effort of the ECtHR’s to balance in the framework of article 6 ECHR the rights of the accused with the rights of the victims is also addressed. Lastly, the ECtHR’s case-law is compared to the European legislative framework.
The analysis of the victims’ status in Greek criminal proceedings begins with the Code of Criminal Procedure of 1834. The Code of 1951 is also mentioned. Furthermore, the incorporation of Directive 2012/29 into national law with Law 4478/2017 is presented. Victim’s rights in the Code of Criminal Procedure are thoroughly analysed throughout all the stages of the proceedings. Finally, there are some remarks relating to the available remedies in case of violations of the rights described.
