Summary:
The retrial of a decision due to false evidence is one of the main reasons justifying the reversal of the precedent. However, in order for the decision to be overturned, it must be proved with legal certainty that the final decision was based on evidence which proved to be false. In the present work, an attempt is made to analyze in depth the fundamental principles of this reason, the conditions of foundation, the specific issues of the lawsuit before it, the methodological possibilities of its application in similar and unregulated cases, as well as its comparative overview with forms of judicial protection.
