Summary:
This thesis discusses the role of the Court of Justice of the European Union (CJUE) in the formation of the European acquis within the field of the tort law. Based on the provision of Art. 340 TFUE, its abundant case-law (in the area of extra-contractual liability of EU bodies and Member-States arising from the infringement of the EU law) not only reflects the relevant “common general principles” of the national legal orders, but also provides important material which sheds light to the process of construction and implementation of the separate elements constituting the tort liability (unlawfulness, damage, causal link). The thesis focuses not only on structural concepts of this legal basis, but mostly on interpretative techniques standardized in the Court’s particular practice (such as the variable use of the notions of “discretionary power” and “sufficiently flagrant violation”), especially in the factual context related to the State and other public authorities. However, this jurisprudential acquis goes beyond the State liability and constitutes a toolkit for the national judge in common tort liability of the private law as well. It is thus necessary to be examined along with other sources of European tort law as co-shaping the overall acquis in this field.
