Summary:
One of the principles whose importance for the modern rule of law has emerged in the post-
war period and increasingly so today is that of judicial protection. That is, the essential

guarantee that citizens and bearers of the rights that the modern welfare state acknowledges
will in fact be able to enjoy them, thanks to the protection afforded to them by the courts
in cases of violation and infringement, whether this comes from the state or from other
individuals. The protection of rights in our country derives not only from the network of

provisions of the Greek Constitution but also from the supra-legislative and supra-
constitutional legal texts by which Greece is bound, namely the European Convention on

Human Rights and the Charter of Fundamental Rights of the European Union. In many
respects their protection coincides, but in others there are differences in the scope of
protection. This paper first studies the relationship between these two texts with reference
to the specificity of the step of the EU's accession to the ECHR, and then describes and
highlights the pivotal and prominent role of the right to a fair trial, not only on a theoretical
level but also as a permanent and persistent mound against the chaos of the possibility of
vigilante justice in the absence of an effective system of judicial protection. In particular,
the protective matrix of fair trial provisions is considered, and in particular their application
to civil and criminal rights and obligations. In addition, more specific aspects of the right
are then discussed, such as access to a court, transparency of proceedings, impartiality of
the court hearing the case, followed by a link to fundamental relevant judgments of the
Strasbourg Court, which basically concern the violations for which Greece was convicted.
Then, special emphasis is given to the individual principles of fair trial that refer to criminal
proceedings, due to the importance of the outcome for the accused, such as the right to
translation, choice of counsel, effective defense. Finally, conclusions and reflections are
drawn on the issues that constitute a persistent pathology of the Greek justice system.
