Summary:
In recent years, with the rise of precarious maritime migration to Europe across the Mediterranean, non-governmental organisations (NGOs) have increasingly deployed vessels to conduct civil search and rescue operations, human rights monitoring at sea and relevant advocacy activities. This dissertation will examine the rights and limitations of such foreign-flagged, NGO-operated vessels in the territorial seas of coastal States vis-à-vis the rights of coastal States. It will take into account various bodies of international and European law, including the international law of the sea, international human rights law, international refugee law, European Union law and the European Convention of Human Rights. The scope of this discussion will focus only on the territorial sea of coastal States, rather than the high seas. It will present a series of examples from Europe to serve as sites of application, while also providing analysis and insights that may be relevant across and beyond Europe.
