Summary:
The subject of this thesis is the individual analysis of the main legal consequences of judgments and orders in the context of tenancy disputes, which constitute one of the most basic categories of disputes in the field of substantive law. First, the main legal consequences that can be produced by a court judgment, namely res judicata, enforceability and bifurcation, and those that can be produced by orders under the Code of Civil Procedure, are analysed at a general level. Next, and after describing the historical development of procedural provisions in lease disputes, the main claims and rights arising under the lease contract are analysed. Thus, after a general analysis of the basic legal consequences of judgments and orders and of the basic claims and rights in lease disputes, the main section of this paper deals with the relevant subordination and develops the issue of the legal consequences that can be produced by a judgment rendered in the special procedure for lease disputes, depending on the type of judgment, with emphasis on the differentiating elements of this type of judgment in relation to the generally valid claims and rights in lease disputes. The same procedure is followed for orders. Finally, the specific and quite interesting issue of resettlement in the tenancy, defined over time by provisions of our procedural law, is analysed.
