          <dc:description xml:lang="el">Η παρούσα διπλωματική εργασία εκπονήθηκε στο πλαίσιο του Μεταπτυχιακού  Προγράμματος Σπουδών του Τμήματος Φιλοσοφίας του Εθνικού και Καποδιστριακού  Πανεπιστημίου Αθηνών και έχει ως αντικείμενο τη διερεύνηση της θέσης της  γυναίκας στην καπιταλιστική και πατριαρχική κοινωνία, υπό το πρίσμα της πολιτικής  φιλοσοφίας και της θεωρίας του δικαίου.  Η εργασία εξετάζει κατά πόσο ο κοινωνικός ρόλος που αποδίδεται στις γυναίκες  μπορεί να θεωρηθεί φυσικός και διαχρονικός ή αν αποτελεί ιστορικά προσδιορισμένη  κατασκευή, η οποία συνδέεται με την ανάπτυξη της ατομικής ιδιοκτησίας, του  καπιταλιστικού τρόπου παραγωγής και των πατριαρχικών δομών εξουσίας.  Υποστηρίζεται ότι η γυναικεία κοινωνική θέση δεν αποτελεί έκφραση βιολογικής  αναγκαιότητας ούτε απλό κατάλοιπο πολιτισμικής παράδοσης, αλλά διαμορφώνεται  μέσα από συγκεκριμένες μορφές οργάνωσης της ιδιοκτησίας, της εργασίας και της  κοινωνικής αναπαραγωγής.  Το θεωρητικό πλαίσιο της μελέτης συνδυάζει τη μαρξιστική ανάλυση της γένεσης  της οικογένειας και του κράτους, τη φεμινιστική αποδόμηση της ουσιοκρατικής  αντίληψης περί φύλου και τη σύγχρονη θεωρία της κοινωνικής αναπαραγωγής. Η  πατριαρχία προσεγγίζεται ως υλικά και θεσμικά συγκροτημένη μορφή εξουσίας, η  οποία διαπλέκεται με τον καπιταλιστικό τρόπο οργάνωσης της παραγωγής, ενώ το  δίκαιο αναλύεται όχι ως ουδέτερος μηχανισμός ρύθμισης, αλλά ως κανονιστική  μορφή που αποτυπώνει και νομιμοποιεί κοινωνικές ιεραρχίες.  Ιδιαίτερη έμφαση δίνεται στη φεμινιστική κριτική της νομικής ουδετερότητας και  στη συζήτηση περί «γυναικοκτονίας» στο πεδίο του ποινικού δικαίου, ως  χαρακτηριστικής περίπτωσης που αναδεικνύει την ένταση μεταξύ κοινωνικής  πραγματικότητας και νομικής κατηγοριοποίησης. Η διερεύνηση αυτή λειτουργεί ως  δοκιμασία της κεντρικής υπόθεσης της εργασίας, σύμφωνα με την οποία το δίκαιο  δεν αντανακλά απλώς τις έμφυλες ιεραρχίες, αλλά συμβάλλει ενεργά στη  διαμόρφωσή τους.  Μεθοδολογικά, η εργασία υιοθετεί μια ιστορικά εννοιολογική και κριτική  προσέγγιση, συνδυάζοντας την ανάλυση της γένεσης θεσμών και εννοιών με την  κανονιστική αξιολόγηση του ισχύοντος νομικού πλαισίου. Η αποδόμηση της  φυσικοποίησης του έμφυλου ρόλου αναδεικνύεται ως προϋπόθεση για την κατανόηση  του ιστορικού χαρακτήρα των κοινωνικών και νομικών δομών που τον αναπαράγουν.</dc:description>
          <dc:description xml:lang="en">This Master’s thesis was prepared within the framework of the Postgraduate  Programme of the Department of Philosophy at the National and Kapodistrian  University of Athens. Its subject is the examination of the position of women in  capitalist and patriarchal society, from the perspective of political philosophy and  legal theory.  The study explores whether the social role attributed to women can be regarded as  natural and timeless or whether it constitutes a historically constructed formation,  closely linked to the development of private property, the capitalist mode of  production, and patriarchal structures of power. It argues that women’s social position  does not derive from biological necessity nor from mere cultural tradition, but is  shaped through specific forms of organization of property, labour, and social  reproduction.  The theoretical framework combines the Marxist analysis of the historical emergence  of the family and the state, the feminist critique of essentialist conceptions of gender,  and contemporary social reproduction theory. Patriarchy is examined as a materially  and institutionally structured form of power intertwined with the capitalist  organization of production, while law is approached not as a neutral regulatory  mechanism but as a normative form that reflects and legitimizes social hierarchies.  Particular emphasis is placed on the feminist critique of legal neutrality and on the  debate surrounding “femicide” in criminal law, as a case that highlights the tension  between social reality and legal categorization. This discussion serves as a test of the  thesis’s central claim that law does not merely mirror gender hierarchies but actively  contributes to their formation.  Methodologically, the thesis adopts a historically informed conceptual and critical  approach, combining the analysis of the emergence of institutions and concepts with  the normative evaluation of the existing legal framework. Challenging the  naturalization of gender roles is presented as a necessary condition for understanding  the historical character of the social and legal structures that sustain them.</dc:description>
