Summary:
Enhanced Cooperation is a procedure where a minimum of nine EU member states are allowed to establish advanced integration in a specific area without the other members states being involved. The creation of the above-mentioned option was dictated by the growing heterogeneity of the Member States, their special interests and needs. The aim of this study is to analyze the mechanism of enhanced cooperation, as an expression of differentiated integration. This model introduces a major exception to the uniform and simultaneous implementation of EU legislation. Ground of justification is that Member States wishing to achieve integration should not be blocked by the veto of other Member States. The differentiated integration triggered by enhanced cooperation constitutes a healthy development of the integration process. At the same time, it has a positive effect on non-participating Member States, which, unable to resist the tendency to advance, will gradually join the ever-expanding integrative alliance.
