Summary:
Present thesis addresses the issues arising within the scope of the national provisions allowing for the arrest of the defendant during the criminal proceedings as a measure for procedural coercion. Particular emphasis is laid on all the different prerequisites, both procedural and case merit based, which legitimize the magistrate to mandate said procedural enforcement measure. The defendant's capabilities provided by law to challenge the legality of the arrest warrant are in turn examined.
