Procedure and substance in the original position- a thesis based on Rawls's Theory of Justice

Substance and procedure is a contrasting pair of concepts among those suffering from polysemy. On the other hand, the “original position” seems to be a fundamental concept in John Rawls’s Theory of Justice, constituting a construction that contributes drastically to the primary goal of his Theory: the selection of the principles of justice that will rule the society. Rawls himself argues that the original position is the most obvious form of “pure procedural justice”. In this paper we set the basis of the doubt of this assertation, going through the analysis of the substantial and procedural elements of the Theory and at the same time reforming and evaluating the rawlsian arguments. Nevertheless, we reject an entirely critical attitude that usually leads us to underestimate any philosophical endeavour and we carefully follow philosopher’s coherent thinking. Finishing this paper, we deal with an argument that meets Rawls’s construction of reflective equilibrium and (alternatively) of the original position as a method of interpretation of the law that can be used by the judge.
