The current licensing regime for television broadcasters and the judgement 95/2017 of the plenary session of the Hellenic Council of State

Τhe authorization regime for television stations has been a field of arbitrariness for decades. The adoption of Law 4339/2015 regulated, not for the first time, the procedure for the licensing of content providers, which triggered a tendering procedure, which was finally canceled, before the judgment 95/2017 of the plenary session of the Hellenic Council of State was published. The main issue before the plenary session of the Council of State was the transfer of the competence to conduct the competition from the National Broadcasting Council to the Minister. For a fuller understanding of the subject of the thesis, the constitutional dimensions are developed until the adoption of Law 4339/2015 with reference to the transition to digital TV broadcasting. In addition, the problem of whether the granting of licenses to content providers constitutes a concession contract within the meaning of European law, is developed. Finally, the question of the limitation of the number of licenses, which did not concern the plenary session of the Council of State with its decision 95/2017, is also developed due to the strong debate it raised.
