The Protection of the Rights of Asylum Seekers under the ECHR. Defining the term "Safe Country" in the light of recent developements.
Summary:
The protection of fundamental human rights of asylum seekers under the European Convention for the Protection of Human Rights is the main subject of this study. The issue of protection provided by the ECHR is approached mainly through the case law of the European Court of Human Rights and especially through the implementation of Articles 3, 5 and 13.
The second part provides an analysis on the meaning of the “Safe Country”, as it appears in the Regulations of the European Union related to the asylum procedures, with emphasis on the issues arising from the implementation of the Dublin II Regulation and the EU – Turkey Refugee Deal.
